Kampala MP Seat: Court orders for retrial of Nyanzi’s Petition against Nsereko

Justice Geoffrey Kiryabwire issued aan directive that Nyanzi serves Mr. Nsereko afresh and the petition be heard again by a different judge.

KAMPALA, UGANDA: The Court of Appeal in Kampala has ordered for a fresh hearing of a petition in which Fred Nyanzi Ssentamu is challenging the victory of Muhammad Nsereko as Member of Parliament for Kampala Central Division.

Nyanzi, the brother to the National Unity Platform President Robert Kyagulanyi Ssentamu alias Bobi Wine dragged Nsereko to the court of appeal saying he made it hard to be served the petition as law required.

This was after Nsereko argued before the High court division that it was illegal for the case to be heard since he was never served prompting the presiding judge to dismiss the case.

Mr Nsereko never turned up in the High Court, claiming that he was not aware of any case filed challenging his victory and that the Electoral Commission that had initially responded to the said petition turned around and asked the High Court in Kampala to dismiss it in support of him (Nsereko).

However, while hearing Nyanzi’s petition on Friday, June 24, the three appellate judges led by Justice Geoffrey Kiryabwire issued aan directive that Nyanzi serves Mr. Nsereko afresh and the petition be heard again by a different judge.
