Why Judicial Service Commission sacked officers Mudhasi, Nabaasa

Kampala, (UG):- Uganda’s Judicial Service Commission (JSC) last week dismissed two senior judicial officers including a Deputy Registrar of the High Court and a Chief Magistrate for misconduct and insubordination.

Her Worship Cissy Mudhasi Kawuma (the Deputy Registrar), and Her Worship Ruth Nabaasa, (Chief Magistrate), were dismissed last month after being found guilty of serious breaches of judicial conduct.

“The Judicial Service Commission (JSC), at its meetings held on January 9 and January 21, 2025, concluded disciplinary proceedings against Her Worship Cissy Mudhasi Kawuma, deputy registrar, and her worship Ruth Nabasa, Chief Magistrate, respectively,” a press release from JSC reads in part.

The JSC further revealed that both Mudhasi and Nabaasa had abused their judicial authority in ways that violated both the Uganda Judicial Code of Conduct and the regulations set forth by the Commission.

Her Worship Cissy Mudhasi, Deputy Registrar, was found guilty of misconduct for ordering the attachment of bank accounts belonging to several entities, including Makerere University, the Uganda Nurses and Midwives Council, and a private individual.

“Her actions in this respect were found to amount to judicial misconduct in as far as they contravened the Uganda Judicial Code of Conduct and the Judicial Service Commission Regulations,” the JSC noted.

Mudhasi’s actions, the commission said, were particularly concerning as she ordered the attachment of the accounts without adhering to the proper legal procedures.

Additionally, she defied instructions from the Chief Justice by proceeding with execution proceedings during a suspension period, which had been put in place to prevent the spread of Covid-19.

Meanwhile, Her Worship Ruth Nabaasa, Chief Magistrate, was found to have similarly abused her judicial authority. Nabaasa was charged with defying orders from a High Court Judge, who had directed her to assess the value of properties involved in a case to determine whether it was within her jurisdiction.

Despite this order, Nabaasa proceeded to entertain a case outside her jurisdiction, leading to a loss for the complainant. “It was established that she entertained a matter outside her jurisdiction in disregard of the High Court order and thereby occasioned loss to the complainant,” the JSC release stated.

The Commission emphasized that “the Judicial Service Commission will continue to maintain the rule of law by upholding the highest level of Judicial accountability.”

The actions by Mudhasi and Nabaasa are part of the broader efforts by the Judicial Service Commission to ensure that judicial officers adhere to the ethical standards required by the Constitution and the Judicial Code of Conduct, reinforcing the integrity of Uganda’s judiciary.
