Kampala, (UG):– The Court of Appeal in Kampala has dismissed an application by Ali Kibirige Muwanga, the executor of the late Bulaimu Muwanga Kibirige (BMK)’s estate, in which he sought to block the sale of a UGX 10 billion prime property in Buziga, Makindye Division in Kampala.
The contested property, located on block 273, plot 46, Mulambula Road, had been attached by Yako Bank Ltd as part of a debt recovery process while Muwanga had sought to block the sale, arguing that his former legal representatives failed to properly advise him on critical legal procedures.
In his attempt to overturn a High Court ruling that had dismissed his objections to the sale, Muwanga applied for an extension of time to file an appeal.
However, a panel of Court of Appeal justices Cheborion Barishaki, Christopher Gashirabake, and Dr. Asa Mugenyi ruled against him, citing unreasonable delays and abuse of legal process.
Justice Barishaki noted that Muwanga had failed to act diligently, as his appeal remained unfiled for 11 months, significantly undermining his case.
Yako Bank Cleared to Proceed with Sale
With this ruling, Yako Bank Ltd is now free to proceed with the sale of the property. The Commercial Court had earlier ruled that the property, which was registered under the judgment debtor, was legally eligible for sale, rejecting Muwanga’s claim that it formed part of BMK’s estate.
Justice Stephen Mubiru of the Commercial Court found that Muwanga failed to provide sufficient evidence to support his claim.
BMK, a renowned businessman who passed away in September 2021, left behind a vast estate, including high-value properties, business investments, and land holdings. His assets have since been at the centre of legal disputes due to their strategic locations and substantial value.
