Mbale, (UG):– The Grade One Magistrate’s Court in Mbale City has dismissed with costs a case of cybercrime and attempted harm that was filed by former Mbale City Education Officer Linus Nasimiyu against Islamic University in Uganda (IUIU) lecturer, Mr Wakhweya Ahamada, citing a lack of evidence.
Presiding over the case on Thursday, March 13, 2025, Magistrate Ezra Morris Oburu ruled that the prosecution had failed to provide substantial proof that Wakhweya had abused or harassed the complainant online.
The court further noted that there was no concrete evidence of the alleged obscene language purportedly used by the accused.
The case originated from a 2023 dispute following a meeting involving clan leaders, local council officials, and opinion leaders. The meeting was convened to address allegations that Clementina Kurima had been forcibly evicted from her matrimonial home by some of her children over property inheritance disputes.
Wakhweya, accused of conspiring with his brother, Khisa Faustine, to unlawfully take possession of family property in Magale Town Council, Namisindwa District, was also accused of attempting to replace Nasimiyu in her city education office role and allegedly posting private family matters on social media.
Speaking after the court’s ruling, Wakhweya expressed relief but indicated that he was weighing his legal options. “I am consulting on whether to sue Linus Nasimiyu for damages and legal costs or to forgive her,” he stated.
