Vipers SC ordered to pay ex-coach Bianchi Shs312m for breach of contract

Kampala, (UG):- Vipers SC has been ordered by the Court of Arbitration for Sport (CAS) to pay their former coach Roberto Luiz Bianchi Pelliser Shs311,600,000 ($84,000) following the breach of his contract. 

Bianchi, who was terminated after just 59 days in charge of the club, had a winless record and failed to score in all seven matches under his management.

The Brazilian coach had signed a contract with Vipers SC that was set to run until June 2024. Despite this, the club terminated his contract in January 2023, citing poor performance.

Bianchi was initially paid a two-month salary as compensation, totalling 43,800,000 UGX. However, he later filed a claim with FIFA, arguing that the termination was without just cause.

The FIFA Football Tribunal initially ruled in favour of Vipers, stating that the termination was in accordance with the contract and Ugandan labour laws.

 However, Bianchi appealed to CAS, which overturned the decision and ordered the club to pay him $84,000 as compensation for early termination, in addition to a return air ticket to Spain worth €1,250.

While CAS rejected Bianchi’s request for additional damages and disciplinary fines against Vipers, the ruling highlights the importance of fair treatment and adherence to contract terms.

While Vipers attempted to justify the termination on grounds of poor results, insubordination, and player-management issues, CAS ruled that sporting performance alone does not constitute a valid reason for contract termination under Fifa regulations.
